What is the legislation around getting the evidence presented by a council for a liability order. Here what happened


I attended court today ( grimsby ) to defend a totally falsy claimed liability order ( NNDR ). I had served a lot of evidence to show this. Upon entering the building I immediately asked the court officer, then usher for a copy of the evidence against me t ( the council claim ). The council officer refused. The court said they didn’t have it and to ask the attending council offecer ( the one I am ackusing of fraud


I explaind to the usher that I intended to use the claim paperwork and report the officer to the police for breach of the 2007 fraud act ( false representation ). The council officer has been able to take the paperwork away from the court today and said he will send me a copy, I do not trust him not to alter it, and the court don’t seem to retain any copy’s of them.


Any idea on what the rules are. Is the usher allowed to not provide me it ?


Are they allowed to not provide me a copy of the evidence to support the claim.

It's possible that the court are just fobbing you off when they say they don't retain copies.

I say this because I asked the same court (Grimsby) for evidence that a Liability Order for North East Lincolnshire council (Council Tax), was in fact issued. They were able to send me copies of the print out, number of accounts on the bulk Liability Order, number withdrawn, my name and the property address liable for the council tax and the liability amount complete with penalty costs.

If I remember correctly they also carelessly left the names and council tax references of four other residents on one of the photocopied sheets. So it appears when they want to be, they can be more than accommodating when you require information. Had I been in the identity theft line of work this information would have been very much appreciated, however, the Information Commissioner's Office didn't seem to think it was that serious.

Astoninshin win today. and very odd

As above, was adjurned on thursday from majistrates court . Attended today. Soon as i walked in, i asked for a copy of the evidence against me, this time, the usher was willing and passed me one sheet with a print out on it.

Did i get a majistrate, now, i got a District judge. I had served the court paperwork that shows 1000s of false liability orders go through each year ( thats another story ) . I puit a cost claim in for £ 10,000 for research approx 30 hours for dealing with the paperwork and attending.

Judge awarded case in my favour, told me to write to him in the next 14 days fully justifying cost and he would award them.

So i need someone to point me to the regs for claiming costs for liability orders hearings

and, any pointer to the regulations around being allowed to see the evidence used agaisnt you in a claim.

The part i missed out on explaining above is the council officer pulled out more suposed evidence, including a lease agreement that unfortunaly for him, ended the day i closed, 18 months ago. It was 7 days short of the natural end of the 5 year lease
