I intend to fulfil the requirements of the demand which states that I need to pay within 14 days or inform them if I don't think I am liable (that time is up tomorrow although I have phoned and tried to explain). I wanted to explain face to face, and have it recorded.

I won't pretend it would be fantastic if you could get them lying on record. In fact, it would be amazing, but I also don't want you to feel pressured into doing anything if you don't feel confident enough or if you feel you will be pressured into making an arrangement.

Whatever you decide to do, needs to be right for you.

Hi Guys
All I can say is what an anticlimax!
I went with the intention of putting my case but the officer (very helpful, thats 2 out 6 who have been helpful) just accepted my statement and SAR, and explained how the appeal process worked. He also confirmed that I had complied with the letter requesting payment within 14 days or informing them if I was disputing liability and that this put a hold on further action. He did try to extract payment by asking me if I worked and suggesting I could pay in installments to which I responded that it would not make sense to pay becuse I was disputing liability and to do so would aknowledge liability for the debt. I have receipts for everything.

If only those idiots who i spoke to on the phone last week had simply explained this to me rather than threaten bailiff action then I would not have panicked. I can see now why many people do panic and pay up.

Clearly I am still not out of the woods but at least I understand the process and have time to prepare my case. Normally the result of an appeal is given within 14 days, although it may take longer in this case because of the SAR. Fine by me, gives me more time and makes them do more work. Hopefully if I continue to press they might take the view that its not worth pursuing.

Evidence of residency

Hi Guys
Me again, am in the process of getting evidence to prove I was living with my parents 1999-2001. As I see it there are 3 sources:

1. The word of my parents (they want to swear an Affidavit)
2. Any correspondence with name and address: This is problematic because like most normal people we dont keep post.
Bank: They have a limited number of letters, 3 from before 1998 and lots from after 2003. I never received any correspondence during the interim period but all the letters they have from 1998 to 2010 are addressed to my parents. They can confirm that my address has been at my parents since 1997 but there are no addresses on statements!
Solicitors: I tried the solicitors who acted for me when I sold the house but they said they only keep records for six years (I have subsequently been informed that whilst this is a legal requirement soliciors will keep records much longer as a matter of practice). Do you think it is worth pursuing this line?
3 Electoral register: I was only on it from 2003 at my parents.

Any other ideas as to where or how I might get evidence?

Also should I send any evidence as I get it, or wait until the appeal decision?

If you are listed on the current electoral register, you do not need to provide further proof of residency. However, if you are not listed, you must provide either one of the following below:

• A copy of a formal tenancy or lease agreement for where you live (not handwritten)
• A copy of a solicitor's letter confirming the purchase of your property

Alternatively, you can provide two from the list below:

• Recent Gas, Water, Electricity, Telephone Bill or Council Tax document
• Housing, Child, Pension or Income Support benefit book
• Driving License with your current address
• Vehicle Registration Document with current address

Also could you produce a rent agreement with your parents

Caspar: Problem is I need documents from 10 years ago-

Since I paid board to my parents, there is no documentation (thus the residency Affidavit), and no bills in my name. I am relying on other documentation such as warranties of purchases, credit agreements, bank letters and solicitors letters regarding the sale of the house. Problem is its 10 years ago and most organisations dont keep copies of this stuff. I really need to do some lateral/creative thinking to get hold of mail with my name and address on.

Two possible avenues are the DVLC, I could SAR them for Driver registration details, and my passport has always been registered at my parents.

I am thinking the more evidence I get the better, even though it may not strictly fall into the required categories.

Further thoughts?
