  • self employent income

I am unemployed and trying to claim CC benefit. My wife has a small business of letting rooms in our property . I sent the council our tax return for the relevant period they however have refuse to accept the expenses . Why will the council not accept costs and expenses whic hthe inland revenue are prepared to do . Further they are demanding originals of all payment sheets for rent and the receipts for food etc.do they have the right o these documents and what happes if they lose then m? or as they usually do lose them .

They profit last year was around £4000 on a turnover of £21000 but they say our incime is too high to claim benefit advice would be appreciated

it really does depend on what you have put down as legitimate expenses, HMRC are more interested in in £££s income and expenditure (individuals tax return), whilst the council are more concerned with numbers vs occupancy and any income generated by occupancy as it has a distinct effect on benefits allowed (household expenses)

you are allowed to question the council and would be well within your rights to seek clarification over what it is they disagree with and why. (my guess is it would be personal vs household stated I&E) one being acceptable to HMRC - and the other would need to meet council requirements

if you are confident, then a telephone call to the council may resolve this, obviously obtaining a letter confirming whatever is discussed would be sensible, otherwise put it in writing to the council
