we bought a house with an annex, it is under the same council tax as the main house, it was built many years ago passing planning with its own facilities such as a kitchen bathroom, bedroom. The council tax increased when it was built, it has a planning condition that says it must be used as part of the main house and cannot be used as a separate unit of accommodation.
However we have just received a letter from the local council saying that they have asked the valuation office to consider putting a band on this annex. They don't seem to care that there is a planning condition on the property saying it cannot be lived in independently of the main house. Can they do this?
Planning department in the council are saying we cannot rent it out in any way unless we have the planning changed, however we would rather it stayed as it is, because we are selling our house - annex included obviously. Seems unreasonable to expect council tax when no one can live in it except as guests to us?
The valuation office seem a lot more understanding however they don't seem to be able to access any documents from the council in relation to this request they say they have sent.
What would users advise?
