  • Filing tax return upon completion

    Could a conveyancer file a tax return without the client paying the tax? I am asking this because my conveyancer didn’t file a tax return upon completion. As a result of this, WRA (Wales Revenue Authority) issued penalties for two separate reasons: 1) late filing 2) non-payment of tax. I agree that i haven’t paid the tax but shouldn’t she have filed the tax return at least?

    I assume this is for the Land Transction Tax [LTT], Welsh equivalent of English stamp duty.

    Did your agreement with your conveyancer say anything about whose responsibility it was to file the LTTR return? If you had no agreement with them to file the LTT return I would expect it to be your responsibility to file.

    Go through all the documentation from the conveyancer and see if filing the LTT return is mentioned at all.
