Following on from a previous thread, I am in the process of trying to buy a property. It was built by the current owners 13 years ago. Our 'current' sticking point is that they have a Building Regulations Completion Certificate, however they do not have the plans that were lodged with the Building Control department. The plans are not available on the council website and the seller is concerned that the plans will have been lost by the council during a move they had a number of years ago.
Our solicitor is saying that without the plans the certificate is not sufficient, the seller's solicitor is adamant it is fine. Our solicitor is saying that they need to request the plans from Building Control or carry out regularisation, their solicitor is advising them to do neither as they will then not be able to apply for an indemnity policy.
The approval reference linked to the completion certificate states 'N/XX/X/XXXX/X - Erection of house. Plans Approved Conditionally' so it is clearly for a house. There is no other house on the site, so, by my logic, the critical parts of the building which form a house such as foundation, damp proofing, walls, sanitation, roof, etc would have been checked.
Is anyone able to advise whether we need really the plans? What real risk are we taking on by not getting them? What is 'normal' in these situations?
