We are purchasing a piece of land at the bottom of our garden from developers who own the adjacent land. They will still own land beyond the piece we are purchasing. They have included the following clause:
The Transferor excepts and reserves out of the Property for the benefit of the Retained Land the following rights:
(a) the full and free right to build, rebuild, alter or develop the Retained Land as the Transferor may think fit notwithstanding that this may result in a reduction in the flow of light or air to the Property; and
(b) the right of light, air, support and protection from the Property for the benefit of the Retained Land.
In part a, what is the meaning of 'notwithstanding'? Does this mean they can build what they like with no regard to our light/ air or that they have to take this into consideration?
