  • Stamp Duty conundrum - Complex

    My wife owns a rental property
    I own a rental property and a residential

    we plan to remortgage the residential to a buy to let in both of our names and simultaneously buy a new residential

    The plan is to sell the new buy to let as soon as we can?

    Questions...

    Will we have to pay the high stamp duty?

    Which house do we pay on?

    Will we be entitled to a refund if we sell the new BTL within 3 years?

    No one seems to be able to answer this question for us and the HMRC say it will take 40 days for a response.

    We have asked our solicitor, mortgage advisor and accountant.

    I'm sure someone can help here.
