HELP Request with regard to Service charges and removal of Tree

  • HELP Request with regard to Service charges and removal of Tree

    Hello

    I live in a house that is freehold and there are 11 other houses. on the same land is 12 flats that were leasehold. the flat owners have now bought those flats and are now freehold. we were all subject to service charges , the flats carry a higher cost than the houses

    the flats have formed a company and outsourced the maintenance general ownership to Countrywide

    so , opposite my house where either me or my wife park our cars is now a very large tree, in fact it is taller than the house and overhangs , it is an apple tree ,so it drops apples onto our cars

    I made a request to countrywide 7 months to have the tree removed. I have chased loads of times. I am now being told the the directors, ie the owners in the flats have rejected my request with no reason

    what are my options ?

    Move your cars then

    Too many trees been chopped down worldwide, I do hope tree has TPO on it....

      It might be worth finding out from your local council if the tree/s has a 'preservation order' (TPO) or a 'Restrictive Covenant' on it - although if it ends up that there isn't one that still gives you no recourse against Countrywide for damage to your cars IMO (as you know that they are apple trees and park there at your own risk).

        Is the place where you park your land, or do you have any exclusive rights over it or is it part of the communal area?

        Presumably the original agreement for maintenance was with the developer.
        When the leaseholders set up their management committee were you invited to join?

          thanks for the reply. we have limited car parking my space , so i park opposite my house. to move it forward , would wind up the neighbours.

          there are plenty of trees further back. to be honest , i would not have had an issue if they had maintained it

          I doubt I have exclusive rights to park my car but I have live in the house for 17 years and always parked my car there and the neighbours park in front and behind.

            Hi

            On your plans, were it describes your right to travel over the comunal land to get to your parking space, it will details whos responcable for the maintainace or any issuse, ( it can be straight forwards, it can also be complex, )

            In relation to trees, and overhangs, thats quite common. Whoever is responcable for the tree, has to maintain it so it doesnt cause disturbance to other properys, this includes overhanges. Find out whos responcable, give them notice to deal with it ( they may have to wait, depending on the tree type. I would not advise removing a tree that near your property without having a specialist asses it first ( incase of subcidence ) and make sure there are insured, Most good firms that deal with trees have one they use.

            Usualy, coppicing or pollarding them would be suitable every few years

            Edited, : The origional plans may be only at your council, or you may need to go search the archives at the council. This will details your parking arraingments.
