  • Compulsory Purchase Order Advise

    Good Morning All,

    I am hoping somebody may be able to offer advise regarding a compulsory purchase order our local council are enforcing that impacts rights of access of multiple houses.

    I’ll try and explain this the best I can so please bear with me.

    The housing estate I live on was previously a council housing estate (built around 1950’s) – 100% of the houses are now privately owned. The houses on my road back onto a large field and between the field and the top of my garden there is a dirt track. This dirt track just leads to a field and is a dead end however around 30 houses have been using this track as access to driveways which they have built to the rear of their property for many years.

    The compulsory purchase order is for this dirt track which is owned by a third party company, I believe this is the same company that owned and built the council estate and houses.

    I’m really just looking for advise on what rights, if any the users of this track have. I appreciate they don’t legally own the land but having used it for 30+ years do they have any access rights?

    It seems you and your neighbours might have prescriptive rights over that roadway.
