A solicitor can also 'attend' a telephone hearing on your behalf if necessary.

      Re: Santander/Eversheds repossession

Just received a phone call it's a hearing 10am on Tuesday.

Been reading other cases cases and now I'm terriefied as its two days before the eviction which doesn't give much time to appeal.

I offered a down payment of 2500 should I pay that before we attend court so I can say this has been paid already?

can I pay someone to attend on our behalf or just me myself? My mother can't attend for medical reasons and my dad has hospital appointments. I can get doctors notes to confirm both. I don't mind attending myself is this allowed? Could I call the court and see if they'll allow it

Is it a telephone hearing or a hearing at court?

Also contacted four solicitors to see if someone could attended all saying too short notice.

santander had our offer on the 1st and didn't responsd till the 16th meaning they've left us with less than a week to get legal representation and now everyone is turning us down.

Could I go on my own

If the possession summons and the mortgage/property is in your parents' names then they (at least one of them) will be expected to be there in person even if they don't speak.

Most county courts have a 'duty solicitor' who ought to be able to advise you on the day and sometimes represent you at a hearing. Call the court to see if there will be one on duty on Tuesday.

Your parents might be entitled to Legal Aid. They really have to become involved with this issue even though you are doing your best to manage the situation for them. DJs don't like to make people homeless but if they're not presented with a reason not to, then they could.

Read this from the Shelter website and call them (Shelter) again with the update in case they can find you a solicitor to represent your parents in court. A solicitor can only take instructions if they actually speak to the person who wants help.

Legal advice on the day of a court hearing

If you have been unable to arrange legal help before your court date, the court may have legal advisers on duty on the day of the hearing.
This legal advice service can be called:
              • housing possession court duty scheme
              • court desk scheme
              • duty scheme

The scheme can provide you with a free specialist adviser on the day of your hearing. The adviser can give you last-minute advice, negotiate with your mortgage lender or their solicitor and speak for you in court
Contact the court and ask if they will have advisers on duty when your case is due in court. Use the Court Finder to find contact details for the court.
You can usually take an adviser, friend or family member with you into the courtroom to help you. If you would like them to speak on your behalf, ask the court usher or judge if this is allowed.

She just won't budge, she has anxiety disorders and my dads obviously got hospital appointments. Is it worth calling the court tomorrow to explain the situation, seeing if I could ask to attend due to the circumstances, all through this I've made them aware of the health situation. Wondering if they didn't attend if I could attend with a letter on their behalf? I know what you're saying but I'm banging my head against a wall. I have a constantly anxious feeling which is making me really unwell.

As both parents are experiencing medical problems can I go in as a " litigation friend " also can someone please give me some realistic ideas on how many people actually get it suspended on an n244 I can prove we can afford it and pay off shortly but worried all the arrears and missed payment promises the judge will just dismiss it

Thank you for everyone who tried to help.

I have never been so low, I'm in bed in tears now. I'm usually very very upbeat.

This is home has been in my family since I was born, and I feel like I've lost it.

The stress from all of this has caused me to lose a baby, which I'm in still in pain with.

My little boy is staying with his other nana tonight but all I want to do is lay in bed and cuddle him.

i feel like I've given up. I can't do anymore. And looking online at things I know the eviction is going to stand.

                      rhanks for everyone's help. I

                          Re: Santander/Eversheds repossession

First of all let me apologise for "butting in"............................................... .........I had an eviction order imposed on me in 2015, it was set aside (through my novice defense) & the initial order from 2008 was subsequently set aside for another hearing.

Without going in to detail, I am only stating, it is possible, to overcome a potentially adverse situation with a bit of good direction & straight thought.
