I have reserved a new build property with Taylor Wimpey (TW) over a month ago. The contract was due to be exchanged 3 weeks ago, but the sales guy from TW told me there was an issue with the back garden (the height of the foundation), so he suggested to resolve the issue first then exchange the contract.
While I was waiting for the garden to be resolved, I discovered TW has done something not very nice to my plot of land.
When I first spoke to the sales guy, I was informed that there was a manhole at the back of the rear garden, and its position was quite obvious (according to what the sales guy said), so the guy suggested to move the manhole to a corner. I thought that was OK so I let him to speak to the site builders.
Then, a week later, I went back to my plot to see the progress. I was totally shocked to see SIX manholes were installed in my plot. I was not happy at all. So I demanded to see the drawing plan. Apparently the plan shows 2 manholes for surface water and 3 manholes for foul water within my plot, but there is no sign for the sixth manhole for foul water. To make the whole thing worse, the manhole that is at the bottom of the garden has not been moved to the corner at all. And also, one of the surface water manholes is now moved to a different location. I am absolutely furious here!
As I said, I was not informed and I was not aware of the total number of manholes in my plot of land when I reserved the plot. I am sure I would not go ahead with this purchase if I knew about these manholes. And now I have already had issues with 3 of these 6 manholes.
Issue 1: A foul water manhole at the bottom of the garden has not been relocated, but it should have;
Issue 2: A surface water manhole has now been relocated to somewhere else but no one has told me about it;
Issue 3: An additional foul water manhole which is not shown on the drawing plan has now been installed in the centre of the rear garden.
Based on these issues, I wanted to know what legal rights I have here. Can I go back to Taylor Wimpey to ask them to re-install the two manholes and to remove the additional manhole here?
