a complicated boundary dispute...

i live i a housing association house and for the last 12 years my garden has been 10 meters wide.
and ive applied for the right to buy. and due to the preserved right to buy they cannot asset strip the property.

a week ago, i got a letter stating the boundary is being moved on saturday, yesterday.

the problem....

the boundary has not moved in 77 years, and every map going shows it in the same place as it has always been.
the housing association wont listen that there is something wrong, they just ignore everything and let the developer move the boundary.
maps from 1948/2003/2004 all show boundary in the correct place.
planning applications and the survey done for the previous sale of the developers property all show the boundary in the correct place of 12 meters.

apparently the only evidence the developer has of the new boundary, is a recent planning application map.

the HA and the developer have been sneaking around making the deal to remove a slice of my garden for the last 7/8 weeks without saying anything. just a solicitors letter stating it will be moved on the 28th...

i always thought i had the right to consultation, but all that happened was the letter.

how on earth does a 77 year old boundary move....

any advice on where i may find more evidence.

So your garden is 12 meters wide and they want to move the boundary to make it 10 meters wide, and developers are developing the land next to you ?

You've put in an application for your right to buy and it is only after you have done that they have suddenly decided to move the boundary?

What stage are you at in your Right to Buy application?

And did they actually move your boundary yesterday?

mine was 10 meters. number 1 under 4035.
next door was 12, there is no 12.5 through to nearly 14 meters.

Looking on Google maps seems half metre up to 2 metres all the way up will lose you a bit of your unofficial driveway and leave not enough space to build a garage if you wanted to in future? Has the bit of land next to you been sold already or are they just trying to nick a bit of your garden to bump up the sale value on that??

Will have to look at the rules ref right to buy but yes does appear they are being naughty.
Did you put in your app for right to buy after getting wind of development on next door land?

some of the others villages around here are much better, there's no village green here.


i applied for the right to buy on the 20th, my birthday and came home on the Monday after to find a special delivery letter delivered through my door apparently signed for, even though there was no one here....

i was told by a housing officer a few years ago that teh HA cannot sell off part of a right to buy property, as you have teh right to buy it in its entirety, as per the tenancy.

ive asked how much i will get knocked of my RTB, and was told if i remember right, nothing, and i asked if there would be a rent reduction, again nothing.

they just stated it wasn't part of my garden in the first place.

i asked about why i wasnt consulted, again the same answer as above.

the HA gave it to him, as he contested the boundaries and used a map that they wont show me, measure up and say that its wrong.

my opinion is that there is something going on untoward.
as it is two parcel they have given him.

the larger rectangle at the back was given to him 4 months ago. and caused a major argument then, where i was threatened by the developer.

i missed one, my garden was 10 meters. and theirs 12 ish.
