  • Repossession

    Hi

Can you please tell me what form I need to get the court to look at a repossession again. They have granted it for February 11th. I told the bank I had moved out of the property in October and that email was a good way to reach me.

Ive just been sent a big bundle of post redirect and all of the paperwork was sent to the old address.

Whilst they can have the property, even though there is a sale progressing which they agreed to, I am not happy with the amount they are claiming, it doesn't add up and they have failed to justify it at any point despite being asked. They also haven't followed pre court protocol.

I want to get the order rescinded (is that the word) and ask for it to be heard again on the grounds I had no idea it was going to happen.

    Thanks,

    Mum

    Re: Repossession

You need Form N244- Application Notice. Set out what you are asking the court to do and attach a witness statement setting out the facts in chronological order. Attach any evidence you have to support your application. There is a fees for filing the application and you should send a copy to the lender. a date will be fixed for the hearing and you should go along and argue your case. Good luck1
