I rented a house on a fixed term AST on the 14/10/13. The fixed term ended on 31/1/14. I paid the fixed term up front and then have continued to pay rent prospectively on the 1st of each month.
I gave notice on 20/1/15 of an intended quit date of the 28/2/15. The agent has stated that all notices must be served on the date at which the initial fixed term AST was started, ie the 14th of the month, and as such the earliest I can quit is the 13/3/15.
I was under the impression that when the fixed term lapsed, a periodic tenancy would start on the 1/4/14 and run monthly thereafter, and as such the rental period would start from the 1st of each month.
It does state in the initial fixed term contract that all notices should be served by the 13th of each month.
Anyone able to clarify?
