  • lanlords flat repossessed?

    Hi! Any advice would be appreciated!

    I currently private rent. My landlord informed me she was selling the property in January, I have been there since last Jan and have a tennancy agreement up to 19/01/14. I recieved a letter basically saying the flat was being repossed as she hasn't paid her mortgage. On the letter it said I have the right to appeal for a two month delay or the lender may come to an agreement if I continue to pay to live at the property. I rang them to query how to go about this and got told ''to seek legal advice. I can apply for tiem but they dont have to accept it's up to the manager and to put it in writing and send a copy of my tennany in'' Is this correct? As if I am not given time to find somewhere to live me and my 1 year old daughter will be homeless? I have a new property lined up to move into but it is not available until jan 15.

    My landlord rang me two weeks ago to ask if I was staying till jan and if I had found somewhere else, I told her I was staying till Jan and she said that was fine and hasn't mentioned anything about this situation? I know she is aware as all her post gets forwarded to her and there has been a few court letters and lots from Santander (the lender) Surely she should have to tell me or give me some sort of notice?

    My rent is always paid in full on time & is due next week. Do I pay this to her? As its for the month ahead and I'm not sure if it will still belong to her?

    Hi Harrietd90,

    I think your best bet is to have a look on the Shelter website, and maybe have a talk with someone at your local CAB.
    Shelter have a section about your situation http://england.shelter.org.uk/get_ad...ndlords_lender which gives you lots of information about your rights as a tenant if the property is being re-possessed.

      the mortgagee co would have sent a letter to the occupier ( you ) read that firstly

      options, you have some, if you reach agreement with the mortgagee co, and pay rent to them, there is no reason why they would have to evict you whilest its going though, unless the property is immedeatly sellable. If you LL hols your deposit or advance rent, start considering that now
      crazy council ( as in local council,NELC ) as a member of the public, i don't get mad, i get even
