    Does the OP want to go down the Legal Route trespass torts ? Easier to reach an agreement with neighbour less hassle less cost resolves problem before it gets out of hand. And makes the Lawyers a few bob.

      Sounds like the best avenue is to have an agreement in place, take plenty of photos, now and as work commences, but be prepared for any problems and nip them in the bud before they get too big.
      Thanks Paul for your valid point about over hanging scaffolding.
      Work will probably start in the next few weeks, so I fully expect to be posting again to get more advice.

        its always worth having up your sleeve if they do start taking the pi$$

        but it is always the best option to avoid falling back on legal remedies unless they are the last resort, so an agreement would be best for sure.
