  • Possession Order......

    Hi,

    This is the first time i am posting!

    I am looking to find an opinion from the readers and get some advice.

    Where to start.............

    so my fathers business went under around 4 years ago and at the time there was a business overdraft of around £90,000 and this was a second charge on the property in question(my fathers house) my father went bankrupt soon after the collapse.

    The whole situation had a very bad effect on my father who is still do this day 4 years on suffering from severe depression and of course this has an effect to him being able to work.

    The advise i would love some help with is on the 28th of August 2012 we went to court where the judge and can i add reluctantly ordered a possession order due to my fathers conditions. The possession ordered he had to be out of the property by september 2012. Due to my father or myself having no funds we could not and did not know how to get legal advise.

    Almost 2 years down the line we have heard nothing and it is still effecting my father in a great way and we would both like to draw a line under the situation.

    I have contacted the solicitors of the bank and offered that the debt be transfer to me and that i could try to pay it off bit by bit so that i may keep my father in the family home. But the email and letters i have sent never get responded to and i a none the wiser to when this could happen or if i can keep the house.

    Any advise would be greatly appreciated as this has been going on far to long.

    Hi Willssc7 and to LB

    Just to clarify:

    Despite a repossession order in Aug 2012 you and your father still remain in the family home and have heard nothing further from the creditor that took you to court. This despite many attempts to contact them.

    Is that correct?

      Should the property and thus the second charge on it not have been dealt with by the IP during the bankruptcy ?

        the only response i we have had is how we are going to pay them back. Then when we go back to them i don't receive any response. We remain in the house still.

          yes but they never included it in the bankruptcy for some reason and the insolvancy transferd the titles back to my father

            Is there a mortgage on the property as well as the second charge and would the sale of the property cover repayment of both ?

              There is a mortgage on the property of also around £90,000. So the house is worth around £140,000 at best so would leave £40,000
