  • eviction warrant

    I have received a letter of eviction from my housing association and been given a date today of 16th April. Please help me I don't know what to do! Can someone please give me an email address so that I can forward the email I have sent to my housing officers today which explains my situation.

          Okay.

          Need to look at some facts and figures first of all.


          How much are the current arrears ?

          How much is your weekly rent payment?

          How much is covered normally by Housing Benefit?

          Once your benefits are back up and running how much do you think you'll be able to budget to pay on top of the Housing Benefit payments to come off of the arrears ?

          We need to put something substantial and factual in writing to the Housing Association. You have got most of the detail in the letter but I think we need to spell it out for them in figures.

          Will help you with a further letter / telephone call.

          Also do you have a copy of the eviction notice from them that you received that you can photograph and email to me ?

                Have you got a notice of seeking possesion order or an actual eviction order, if it is a PO you can be asked for it to be suspended called an (SPO )pending an arrangement between yourself and The HA. They are obliged by the Court to make every effort to come up with an arrangement that you can afford by filling out a proper account/investigation of your circumstances ( I used to be a Housing Officer) I have got an order disallowed by proving that the amount they were asking for was unrealstic my client only had about £60 left over a week and they were asking for £50. It is important that you attempt to make regular payments as much as you can afford, I would have thought that if its a benefit delay with all the current problems with switching to the current new system would also allow for further delay . Try to do everything you can as if you are evicted it is likely that they may class you as intentionally homeless and you may lose your access in future to social housing. If they consider you in priority need you may be place in temporary housing usually hotel/hostel rooms while they assess your needs. In theory you will still be able to claim Housing Benefit on a private property. If you can get an advocate from housing aid at your local council or welfare rights it will greatly increase your chances of sucess as you would also benefit from professional advice/support. In my experience housing officers are given strict targets to reduce rent arrears and are often presssured to evict people , which in part is why I left housing management. they are usually unaware though that they can be challenged so it is definitely worth a go. let us know how it went if I have a few more details I would probably be able to give you more specific advice. good luck

                  Have the housing association issued you with a valid notice? This has to be in the form of a section 8 notice or section 21 notice. If they haven't served you with either of these then the notice is not a valid notice.

                    Yes, please could we see what you have received in the way of notice?

                    Also the reasons given, and do you think those have any validity?
