    hi,
    my tenants are currently on a statutory periodic tenancy tenancy and have expressed an interest in purchasing our property. I have had a look at our agreement with the agency and it states that "in the event You decide to sell the property and the agent is able to demonstrate that in relation to the sale they have provided YOU with estate agency services, the agent shall be entitled to charge you a fee of 2% plus VAT of the negotiated purchase price". if I were to use a different estate agent to value my property would I still be liable to pay these charges. I understand that the agency have provided me with tenants as they have technically provided estate agency services; however there were significant initial costs, we also paid significant costs to improve the property to make it habitable for tenants, therefore the value of the house has increased, therefore the agency will get more money. The other factor in to the tenants wanting to buy is that they have built up a good relationship with my partner and I. I feel that I am going to be penalised as if I was not tied in with this agency then I could sell my property t the tenants and just incur solicitors costs. is there any loophole that would benefit my tenant or myself so as I would not have to pay these fees. additionally if I were to ask my tenant to put notice in then sell to them after notice what fees would Incur and would it be legal? any advice would be really appreciated, thank you in advance

      Initial thoughts: as it seems from your post that the agency introduced the tenants to you, it would seem they can charge you the agreed %age, even if your tenants handed in their notice and then purchased the house.

      By improving the house you have increased its value, and so the agency will gain, but so will you.
      House prices rise and fall and fees are normally calculated on final selling price, not on value when agency agreed

        Thanks for your reply, I have just returned from the agency, I did a bit pleading etc, and asked if they could waive this fee as if they didn't then the sale of the house would fall through. They agreed to waive this fee to my amazement! They did however say that the tenants who want to buy would have to pay fees etc so in the end the agency is not really missing out.

          IS the tenant willing to pay the fees and do they know how much this could stop the sale hope not

            hi, the tenants are willing to pay necessary fees. the sale of the property would have fallen through if the agency didn't negotiate; thankfully they (the agency) did, so was good news to us and the tenants!!
