    Hi, Hope you can advise?

    I entered a joint mortgage 11 years ago and separated and divorced from my wife 7 years ago with the agreement that she would pay the mortgage and keep the house.
    I am now due to get remarried and would like to set up home with my new wife, the problem being is I need to come off the existing mortgage to be able to do that, I have approached my ex wife and she has approached Nationwide and they can offer her £123000 mortgage but there is £159000 left to pay. She hasn't always payed on time which also affects my credit rating which I have no control over.

    Can you help with any options I have or options I can advise my ex-wife that she can do please?

      Hello, and sorry this has been missed, it does sometimes get very busy on the forum with lots of new threads and posts but I hope there is still time to help you.

      If you are still registered on the mortgage with your ex-wife then you need to send a SAR to the lender to obtain all your paperwork.

      You need to obtain a copy of the underwriting sheet and a full statement of account showing all the transactions on the account including fees, charges, and interest added to the account.

      Once you have these you will be able to work out how much you can claim back from the lender to bring down the balance of £159,000 that they say is still owing on the mortgage.

      Once you have obtained the information then come back to us and we will try and help you identify what, if anything, you can claim back.

          I know that but if the gentleman wants to get his name off the mortgage and his ex-wife can only get £123,000 anything that can be claimed back can be taken off the balance £159,000 and allow his ex to get a mortgage in just her name leaving him free from any charge so he can then get a mortgage with his new wife.
