  • Help urgently needed how to audit my mortgage and take the next step against lender.

I need to build a case against my lender who is a nightmare, bully and fobs me off with lie after lie when I complain.

Already sent DSAR to them which came back long after the 40 day limit with a letter stating they are unable to retrieve over 2 years of my account information which just happens to be the years when I believe they screwed me up big time, as this was the time my interest only loan the amount outstanding increased by some £5,000.00 I have already filed a complaint with the ICO in respect to SAR being late and the fact that they are unable to retrieve data they hold and am awaiting the outcome.

Included with the SAR was some accounting records 2008 onwards, letters and my original loan application, conditions the letters they sent confirm that they had applied many arrears charges, But I don't believe it will enable me to get a full picture of what the crooks have been up to since they took over my loan in 2006 from another lender and this happens to be same time they say they are unable retrieve the data from which is very convenient for them.I don't have any records of my own just my bank statements which show the payments I made.

I need help making a case, need some one to explain about how to check if the interest they charged is the correct amount also if it is the correct rate. Need to know how and where I must go to bring the crooks to account for their actions. Not sure if the mortgage is regulated or unregulated.

I would welcome anyone pointing me in the right path as I just cant take it any more we should be retiring my wife is nearly 65. My wife took out the loan back in 2005 using a broker when I was ill,I didn't see the broker at the time and had no ideal that the loan was interest only BTL, I Just signed deeds and loan agreement along with my wife. In fact its only last year that my wife and have now fully realized that we are now stuck with an interest only mortgage which has been securitised (God bless America) by a bankrupt lender and is being serviced by bunch of crooks and that according to the loan conditions we or our children don't have any rights to live in the property.
