    Good evening folks,


    I am seeking advice on a housing matter.

    I live in a block of flats, as part of the tenancy, each flat is provided with a bike shed on the ground floor, the sheds are numbered to correspond with your flat number. I have lived at this address for 10+ years and for a number of years I did not make use of my allocated shed at all. One of the other residents removed my door number from the door of my shed and began using it to store their own things. Approx 2 years ago I needed to start using my shed so I contacted the landlord and also personally asked the resident to vacate my shed. 2 years on and this resident still has her own padlocks applied to the door and is storing their belongings in my shed. The landlord first stated to me that they would force entry to the shed and provide me with keys, then later I was told that they need to do an “audit” of the sheds to establish who was using what. To date, no audit has taken place, no keys have been provided to me and the other resident is still making use of the shed. I am mainly being ignored by the landlord now and at best their answer is just “we will get back to you”.

    What I am trying to find out is what my rights are with regards to getting my shed back. Am I legally allowed to force the lock? Or ask the other resident to vacate within a certain amount of days? Please can you tell me what action I can take? Could I use an outside storage unit of a similar size and send the bill to my landlord? Or am i due any sort of refund from the landlord for all this time not being able to use the shed?

    What mention of the shed is in your tenancy agreement?

          Following on from the question posed by Tools ... is there any mention at all in the tenancy agreement about 'storage' or 'other facilities', or suchlike?

          The absence of any written reference is not necessarily the end of the matter, although it does make it much more difficult.

          Essentially, you are being deprived of a facility that you are paying for.

              If the shed is not in your tenancy agreement and you have allowed (by not complaining) another person to use the shed allocated to your flat for a number of years then you may find they have gained the right to use it. The shed is separate to your flat and not in your tenancy agreement so it might be that if you broke into the shed now it would be criminal damage, trepass, theft etc so I wouldn't recommend it.

                Thanks very much for all your replies, I will go through my tenancy agreement with a fine tooth comb to clarify if there are any mentions of the shed in any section....
                With regards to Amethyst's post..... Are you saying that this other resident has a form of "squatters right" over my shed? Did they not commit criminal damage when the broke off my lock and sloppily removed my metal number plaque from the door (leaving damage)?

                  I'm surmissing it may be the case for the assessment of whether you have the right to break in, particularly as it isn't in your tenancy agreement.

                  Do you know how long ago they took over 'your' shed ?
                  Did you do anything about it at the time ? (until 2 years ago when you approached them and the landlord)

                  Also - is your landlord the same landlord as the rest of the building ? (Is it private or HA?)

                    Sorry to say this but I think your making a mountain out of a molehill check the agreement
                    As for criminal damage by the other tenant are you going to the Police with the accusation probably not ?
                    If you o have a right to the shed put it all in writing to the landlord its their problem

                      Apologies..... My use of the word "landlord" was quite ambiguous, it is in fact a council property managed by a housing association and the entire block I managed by the same firm.

                      In answer to your question regarding the length of time this person has been using my shed, I contacted my housing manager the moment I noticed the locks had been changed etc. There was no period where I was aware of this person using it and I did not take action.......

                          I agree that it does seem like a small issue, but considering I have zero storage space in my flat and desperately need extra storage space, this matter feels important to me. You said I'm probably not going to the police but I'm trying to establish if I even can. The landlord does not seem to care, so I'm here trying to find out if I have any rights and what they are....

                            Well that's a different matter If you complained when you noticed the damage it is up to the HA to sort out. In your initial post it sounded like it had been over most of your 10+ yr tenancy and you decided 2 years ago to use it....so ....still don't break in though, but you should be a bit firmer with the HA, are you putting your requests in writing ??

                            (and actually had you had stuff stored in your shed you may have been reporting it to the police as a break in))

                              Having dealt with HAs I can safely say they are the least helpful Charities there are your right they don't care so keep it all in writing.
