  • Service charges question in relation to housing association

    A friend lives in a maisoinette The housing association decided in 2007 to install a communal aerial which my friend objected to being part of. The rent and service charge annual statement records it as
    a service charge for 'tv connection point' However, in her case due to her objections they havent come in and fitted the connection plate in her front room, but have billed for it and chased for 6 years. Now they are trying the court for possession. She argues that as it has never been fitted she should be made to pay for it.

    Also argued is the fact that the TV reception from the pre existing and still used loft aerial was adequate and she had no need of the communal aerial and that indeed the landlord had no need to fit anything because most TV owners with a working roof aerial would not need a new aerial according to many sources such as Digital UK who helped government prepare people for switchover

    The other argument is that the prolonged pretence, for 6 years (including 3 Notice of intent to possess) deprives them of the right to make the claim as 'estoppel ' should apply because of acquiesence
