    Hi,

    Excuse the title for this but don;t really know how else to describe him. My mother and dad moved into the property she is in about 18 or so years ago. Sadly my dad dies quite a while ago, and my mother carried on living there. She has arrears on her rent of £1000, which she has told the landlord she will pay as soon as she can, but here is the problem. He is phoning her all the time asking is she has paid the due rent, and if not when will it be paid. The rent is due on the 1st of each month, and he starts phoning about the 28th of each month. My mother is 78 years old, and struggles to make the rent payments each month, and has applied to the council for a bungalow, but because of the arrears she has they say there is nothing they can do, she has to pay the arrears off first. She has asked the landlord if he would come to some arrangement to clear the arrears once she has moved, but he is unwilling to do so. He has done no repairs to the property whilst she has been there on her own. The central heating keeps breaking down, and he just get the engineers in to fix it, even though they say it is so old, it needs replacing. The cupboards in the kitchen under the sink have collapsed, and the bath/toilet has a leak. She has been telling for months about these problems, but he doesn't seem interested. All he says is he needs his rent because he has bills coming out of his account and they won't get paid if she hasn't paid. He used to own all 5 houses in the row where she is, but has sold 4 of them. He keeps telling her he can get more rent if he rented out to some one now. It has got to the point where my mother does not want to answer the phone any more in case it is him... She asked him to give her notice, but he won't do that, because he knows he will have to do the repairs to the house before he rents it out again. In all the time that she has rented the property, he only started putting the rent up after my dad died, but he has never given her a new tenancy agreement with the new rent amount payable each month. He tenancy agreement still shows the original rent amount of £350 per month...

    Could some one please give me some advice on how to stop him harassing my mother. I have said i will see if there is any one i can report him to regarding the harrassment and also non repair of the property.

    Any advice would be appreciated.

    A landlord is required, by law, to carry out repairs unless the tenancy agreements makes the tenant liable for repairs. As for the increase in rent, strictly speaking and unless one of our more learned members states otherwise, if the landlord has not notified your mum of any increase, IN WRITING, and afforded her the opportunity to terminate the tenancy, then he cannot charge the increased rent.

    With regard to the boiler, is it electric or gas? If gas, has the landlord had mandatory safety checks carried out on it and have any safety certificates been left at your mum's house by the engineers who have carried out the safety checks? Although they have said it needs replacing, have they condemned it at any time?

    The landlord is in breach of his legal obligations in a number of ways and it would be wise to consult with a legal professional about this.
