  • Taking My Mortgage Broker to Court.

    Can anyone take their mortgage Broker to court?My Mortgage Broker does not lend anymore but failed to tell me this when I approached them to tell them that I would be facing difficulties in the future to pay the full amount on the mortgage account.They never offered an alternative payment plan i.e holiday break.They just directed me to the Government Mortgage Rescue Scheme knowing that their last valuation on the property was approx £86.000 over the capped amount.

    Usually a broker doesn't lend, they would guide you towards a mortgage provider.

    Any rearrangement of a plan would then be negotiated with the provider. Are you sure that you have approached the correct organisation with your payment problems?

      My Mortgage was arranged by Central Trust...I've since found out that it was through Barclays!I was not told this at the time of taking it out with them.

        Have you approached Barclays to negotiate a payment plan?

          I only found that it's with Barclays after I changed the way I paid CT...They told me even thought the payment is going through their Bank Account.They then have to pay Barclays.

            Still confused, is your agreement with Barclays or CT? It does make a difference to what routes are open to you. Is it clear in your signed agreement?

            You can sue for poor advice but it is a different matter challenging the terms of a legitimate loan. In that case you are best to try and negotiate a more favourable deal, or change provider. You appear to have tried to ask for some flexibility and this has not been entertained by CT, they have guided you towards a government sponsored organisation who help as the last resort. It appears however that you have not had the opportunity to explore options with your lender to get to the last resort.

            That is why it is essential that you are certain who your lender is.
