  • Housing association tenant, Scaffolding put up without informing me.

    Hi all,
I am a housing association tennant that lives in a terraced house, i returned home from work 4 weeks ago to find scaffolding in my garden. my neibours are having their gutters cleaned (they are with the same housing association). I had no prior notice that their would be any works going on and this scaffolding is now blocking my garden, i cannot open my garage door. I cannot get my car out of my garage and i dare not let my kids play in the back garden as they are only little and wouldnt understand to stay away from it. I have called the council who said the scaffolding will be taken down after 2 more weeks, they still havent been out to clean my neibours gutters. I asked why they needed to play the scaffolding in my garden and they said the neibours requested it as it would block their sky receiver dish if they had it 100% in their garden. But guess what, they placed it right in front of mine. I called sky but they said they cannot and would no do anything as i am out of contract but i could pay them £60 to move the dish. sky wouldnt even let me cut my sky subscription for the month as i hadnt given them any notice.

I know this may sound trivial to most reading this but after a 10 hour shift at work all i want to do is unwind in front of the TV. sky dont care, the housing association dont care.

I am guessing all i can do is put up with it as the housing association owns the land.

any advise on my standing would be appriciated.

    Rob

As your landlord, the housing association is not allowed to do anything which affects your enjoyment of your tenancy, which includes blocking your access to your garage and preventing you from using your car, which is currently incarcerated in the garage, thanks to the scaffolding, and affecting your tv reception.

I would be inclined to speak to your local CAB or Law Centre about the problems you are currently experiencing and see if you can negotiate a reduction of your rent for the period your enjoyment of your tenancy was affected, loss of use of your car and refund of Sky subscription as you are not able to view tv because of the scaffolding on a pro rata basis.
Life is a journey on which we all travel, sometimes together, but never alone.
