You should write the letter, send it to them by recorded delivery and keep a copy - then you can show a court you have tried to clear the situation up.

If your dealings have been with the mortgage brokers then everything and anything must be done in writing with them as well as anyone else you are corresponding with. If you speak to them on the phone, then write a letter to them confirming the conversation you have had. You can send recorded or get proof of postage which is free over the post office counter. You could also reply to whomever has written to you (your old landlord) to say you have forwarded his letter to the brokers with whom you have an agreement and are awaiting their response (copy the brokers on this letter). Just to check, was the rolling agreement ever changed to reflect them as the landlord? Note if you are rehoused then you will, under the rolling agreement, have to provide written notice or you will be liable for the rent. You can't just move out. As someone has mentioned, you can contact the land registry to see who owns the property.

Do you have a tennancy agreement?

If you do what are the terms of that agreement ie can they give you notice to quit and if so how much notice do they have to give you?

Or are you a sitting tenant?

Having read through this thread, I am beginning to wonder if the landlord is trying to avoid compliance with applicable legislation. Not a clever move on the landlord's part.

You might be able to negotiate with his Trustee in bankruptcy to become their tenant at least for the time being. However, if they are trying to sell the property, they will ask you to leave and it is lawful to do so providing this is done properly and you are given suitable notice etc.

Get in touch with the Insolvency service (They have a regisiter) they will advise who the trustee in Bankruptcy is and then you could go from there.

I am advising in a similar case which is not on LB, I thought that the landlord had deafulted on the mortgage here.

The receivers are likley to want vacant possession to sell the property. On the other hand, if you are in a position to buy it from them, they might accept a very low price.
