Claim advice needed

Ok guys before i begin i think its appropriate to let you know this is an automotive insurance claim. However I feel the areas I need a bit of advice with are quite generic for some of you guys.

So I had an accident in December. I was driving down the road and a lady lost control of her car coming out of her driveway and shot across both lanes of traffic.... only problem was that I was in the other lane and she ploughed right into me. (her front end into my rear quarterpanel)

After trying to drive off and stopping 40 metres up the road she was very apologetic and happily exchanged details. That evening her husband came to my home and asked me to settle outside of the insurance. Anyway long story short he made me feel really uncomfortable so i contacted my insurer.

Provided photos, diagrams, statements and an independant witness so pretty clear cut. Today I got a letter telling me that the third party has remained silent and refused to provide statements ect and ognored correspondence. They are not responding to my insurance company or their own.

How long can these type of individuals get away with this? To be honest im not really to bothered if it takes a year or even two but i would really like to know what kind of duration they have.

Any insight would be greatly appreciated

Many thanks, obviosuly my other scenario takes presidence over this one. but it would be nice to have a clue as to how long these people can get away with this kind of behaviour.

Her poor driving caused damage to your motor car.

Your insurance company will seek to recover the cost of the repairs from the other driver; if she is insured, they will claim from that company but, if she is not or if she refuses to cooperate, they will claim those damages directly from her.

She is insured, we managed to verify that. The big problem is she has remained unresponsive towards her insurance company. Initially because of the lack of response her insurance company disputed liability to grant them time to acquire a statement from her.

Since then they have had to send "claims investigators" to acquire a statement but they have been unsuccessful thus far. The photographs clearly depict her and her car along with registration no and a photo of her vin no. so theres no denying it was her. The damage proximity is quite clear cut as the only way i could of caused the damage is if i were driving a crab mobile (sidewards).

It is such a shame she is doing this, I have no bad feelings about the accident, she simply lost control..... it happens. Just wish she would at the very least provide a statement. I know my statement is 95% in agreement with the independant witness statement, along with the damaged areas of the cars and the fact that she drove onto the wrong side of the road. I feel this should not worry me to much...... hopefully.
