  • Reclaiming Fees

Does anybody have a list (or start of a list) for fees that I may be able to reclaim for a mortgage with Abbey that was redeemed about 2009 (can look up exact date if needed)?

The mortgage had not been well maintained, had incurred many late payment charges, unpaid DD charges - all the normal nightmare things. It was redeemed early, incurring both early redemption fees and an exit administration fee.

If anyone has a list or any suggestions of fees which may be able to be challenged, I'd be grateful (along with any associated legislation if possible).

    Thanks as ever,

    Re: Reclaiming Fees

I asked a similar question some time ago on my Rooftop thread and this was the answer I got:-

ARREARS LETTER/PHONEALL FEE £25.00 - Claim it. They will doubtless tell you that it costs this, but do they telephone you and if so, how often? Irrespective of what they will state, they must also prove it

ARRANGEMENT FAILURE FEE £30.00 - Claim it

SOLICITORS FEE £74.75 - Difficult one, they are entitled to recover their costs with regard to litigation. Claim it anyway and you can always remove it from any settlement arrangement you might reach.

ARREARS MANAGEMENT FEE £75.00 PER MONTH (NOT SURE IF THIS IS CLAIMABLE) - This is most certainly to be claimed. How on earth does it cost £75 per month in addition to the other charges they also pile on?

UNPAID DIRECT DEBIT FEE £30.00 - Claim it

PENALTY FOR NOT PAYING DD £10.00 - Claim it

Also the best route for this is the FOS and not the court route once you have a definate no, no from your Mortgage Company. I am going to be doing the same, I held back when we were in huge arrears and was on a suspended possession order against us. We are now fully paid upto date with the arrears and now they are chasing us for these charges, so before we get more solicitor letters etc and more threats which is what I suspect will happen next I will start this process. It is not quick fix through the FOS as it could take many months but it does not cost anything and apparently it works and whilst it is with the FOS the mortgage account is in dispute.

Just use one any spreadsheet to list your charges and I would add 8% interest. Although I understand that the charges maynot be attracting interest.

To get a full list of your charges if you have not got a definative statement send a SAR.

      Re: Reclaiming Fees

      Thanks Tuttsi,

I will need to SAR them, but didn't want to fork out on that before I knew there were charges I could reclaim. I know that for two years we were always robbing Peter to pay Paul in order to try to stay no more than three months behind as this is when they said repossession would kick in. I remember a lot of charges, but obviously will need a breakdown of all of these.

Thanks for your help, I'll keep you updated.
