  • Land- is it possible to have land on your deeds you dont actually own?

    Hello all. I was wondering if anyone could confirm if it is possible to have land on your deeds that you dont actually own but are responsible for ie the upkeep of a drive.

    I ask as we are having problems with our awful neighbours. We bought our house a year ago and in our papers it says the middle of three drives infront of our house is a shared drive between us and next door. The one to the left is ours and the one to the right is theres. They are adamant they own the middle space and block us in if we ever park on it. I have been round to all the other houses on the street that are in the same situation as us ie two houses with three spaces infront and they all say the middle one is shared so i cant see why ours would be any different.

    I have today spoke to the company who built the houses and they say that this is correct but on the deeds the middle space is on next doors deeds because they are only responsible for the upkeep of it but they dont actually own it. I hope this makes sence?

    must admit. if it was on my deeds, and i was responsible for the upkeep, id be sure as dammit no one else was parking on it

    If i was you, i would contact either the council or the land registry and ask for arbitration to resolve the dispute, not sure what else you can do under the circumstances

      I assume the middle one is allows right to access, to access the back of your houses for example, and hence why they are shared. Though it is strange that one household is responsible for the upkeep and the other is not if they are deemed as shared in the deeds, i would have thought both would be responisble for the upkeep if shared. But if it is right to access, then you do not necessarily have any ownership of the third drive, but merely a right to use it to access the back of your house etc.

      I would certainly do what Stevokenevo suggests above to get some sort of resolution to this issue. If it turns out you do have right of access, then their blocking you in maybe an offence.
