  • Insurance advice needed !

    Hi peeps,

    Sorry if this rambles on but please bear with me.

    Some of you may know that I have a small business, well I rent an office situated in a garden centre and have been very happy there for the last couple of years, we are one of many businesses based on the site, ranging from offices, to shops to a lovely tea rooms.
    Please bear in mind that we are situated less than one mile from Dale Farm Travellers site.
    A few months ago a young ish lady in a big American sports car lost control completely and propelled into the big double metal gates that are across the entrance off the garden centre, basically wiping out the car completely and leaving the gates so damaged that the only way to secure them now is by a big chain and padlock.
    The site owners were insured etc and we were told not long after that the insurance had paid out, so we were expecting lovely new gates to be fitted.
    Not So......
    The site owners have built a very large, impressive house a mile away and guess what..... they have lovely new gates at the front.
    Now bear in mind now that the gates on the site are damaged with just a chain holding them together, that a couple of the businesses have had break ins in the last couple of months (shops with tills, its money they are after).
    We are having a site meeting later this week and want to address the security issue amongst other things.
    What I want to know is .....
    If they have used the insurance to put shiney new gates on the house is this fraud ?
    Can we threaten to inform the ombudsman etc ? Who would it be ?
    Are there any laws, legalities we can quote, just to make it look like we know what we are talking about ?
    Also, when I drove past there late the other night we noticed that none of the security lights were working, can we throw that in the mix too ?

        The security of the site - gates, lights etc- should be covered in your tenancy/rental/lease agreement, or under any service charges you pay for maintenance etc.
