  • Unusual query regarding mortgage offer lost in solicitor's office fire!

    Hi guys!

    Not sure if anyone can assist me with this one at all or if I'm in the right place!

    Yesterday we were due to exchange on our property sale and purchase, although this had been pushed back from an earlier date 'cos our buyers' survey results took longer than expected to come back. All along our buyers have been pushing for early completion and as their buyer goes on holiday on Saturday 21st May, it was agreed that we would complete on Monday 16th. This left a smaller window between the two than we would have liked, but thought we should be amenable to their requests so as not to lose the sale.

    Yesterday we got the unexpected news that our buyers' buyer's solicitor's office had been destroyed by a fire in the eearly hours of Sunday morning

    Apparently no-one was hurt thankfully and initially our solicitor said it may only delay things by 24 hours.

    Today, however, they have said that if the person's mortgage offer was lost in the blaze there is a chance they will have to re-apply for it - which sounds rather unfair as it was no-one's fault that this may have been lost.

    Does anyone know whether this could be true or not please?

    Blimey what a shocker, anyway that does not sound right as surely the mortgager has a full record of the mortgage offer so all that would need to be done is for them to forward another set of documents.

    Also why should the buyer have to go through another credit check through no fault of there own.

    The mortgager has a record of this offer so to have to re-apply does sound strange.

    Is the solicitor saying that they only print one copy as that cannot be right.
    If you think nobody cares if you're alive, try missing a couple of payments.

      Thanks PF - yes, what a bummer, eh? At least there were no casualties in the blaze, although it must have been pretty bad as apparently there were 100 fire-fighters tackling it

      As you say, I cannot understand why there person in question would have to go through the whole rigmarole of re-applying/credit checks etc as a result of something that was out of their hands.............it seems absolutely crazy! OH spoke to our solicitor's secretary and it was she who said about the re-applying etc, but I'm not sure what was said exactly - I wish he hadn't told me to be honest as it was the final straw today, what the oven debacle in my other thread and many other little things that seem to be going wrong with the moving process.....................I'm beginning to wish we weren't moving

      According to the sol's website they are trading as usual, but I find this hard to believe when you think their building was gutted. There are rumours now that it was either started by someone with a grudge against the sols or else the previous tenants of the shop below the sols office (a Londis which apparently was hastily vacated in the last couple of weeks) - someone said it might have been an insurance job...............well, whatever it was I just wish they'd waited till after we'd completed, lol!

      Time to go off and have an early glass of vino, methinks............if I can find a glass amidst all my boxes, bubble wrap et al!

        OH has spoken to our buyer (who had initially tried to blame us for the delay even though there were just as aware as us of the unfortunate fire incident ) and he told OH that he's heard from their buyer today - apparently they were going to see their lender this afternoon to see where things stood. Our buyer realises now that we haven't done any of the delaying in the whole process and indeed have been most amenable to everyone else's wishes from day one. All we can do now is wait to see what tomorrow brings forth. In the meantime I've decided to take a break from packing this evening and will try to relax a bit instead!

              Quick update guys - have spoken to our sol (herself, not a secretary) today and looks like exchange may now happen Monday. Also our buyer has spoken to theirs (the ones who lost their p/work in blaze) and they are busy getting copies of all their docs together, so hopefully Monday exchange and Friday completion is not out of the question

                    Such a major conflagration suggests that someone used far too much petrol.

                      Firms should have all the documents backed up remotely from the computers.

                      It soes sound rather bizzare for such a large fire though if it were say just an electrical fault, unless it was started deliverately. If it were I am sure the Fire fighters would be doing there investigations.

                      In the meantime fingers crossed for you Nellie that it can all take place on Monday xxxx

                        Thank you Tuttsi , you would think so in this day and age. Hopefully the fire service will get to the bottom of it soon, but there is an update and it's very good news -

                        We exchanged contracts today and will be moving on Monday 23rd May!!!

                        It's only a week later than planned but will give us a bit more time to organise stuff..............and finish our never-ending packing, lol! Our buyer's buyers have had to postpone the start of their hols in order to do this date as our buyer had stipulated they couldn't leave it any later 'cos of work commitments (otherwise it would have had to wait till July!) so despite it being Friday 13th we got there in the end!

                            I know, especially as only yesterday we thought the whole chain may fall apart - I'm really excited now, although the new house is a major project so it's going to be some time before we are as comfortable as we are now! Just getting away from an area where we've never settled will be wonderful though so I'm prepared to put up with anything
