OK, this is one for the riddle solvers amongst us.
Friend is mis-sold a mortgage by Broker A. Firm collapses, she applies to FSCS for compensation.
Broker A only gives business card when selling mortgage - nothing else. On the card is his name and the name of the firm - let's say Abra Ca Dabra.
Abra Ca Dabra is listed on the FSA register as having belonged to Ms W, sole trader, who is authorised in her own right. So friend assumes Broker A was working for Ms W.
Broker A was never authorised in his own right but must have been an approved person with a Principal. Building Society unable to give the registration number he used to make the application.
Now, friend has just discovered on OFT register that Broker A was also working at the time the mortgage was sold as a sole trader mortgage broker in his own right BUT registered as Abra Ca DEbra.
Both firms used the initials ACD to trade.
Who does friend make the claim against? I am of the opinion that it is him as a sole trader because he sold her the mortgage, no matter what was on his business card said. This may have to go to a lawyer.
