  • Taking a name off ???

    Hi all, I'm wondering if anyone can give me a bit of advice with this one.

    The girl that works for us part-time was divorced around 10 years ago and she kept the house, albeit on a mortgage, she had 2 children at home at the time, both left school now, one lives away the other has a good job.

    She was working in a school and also evenings in a Chinese Restaurant, she then she met a guy who worked there (from Hong Kong), they fell for each other, she got pregnant and he moved in, they had a little girl who is now 6 years old.

    They realised that the house was a bit small and she re-mortgaged to get money for an extension, stupidly (she now realises) she had the new guys name added to the mortgage/deeds.

    All was going along ok, he gave her money for bills etc, until last year when she decided that she wanted him out of her life, eventually late last year he moved out and rented a room in the next village to us.

    She has since decided that as its not a nice split and she wants him totally out of her life, that she wants to either sell up and move, but as she is part time she cannot get a large mortgage and would have to move to a less than fantastic area, or stay in the house and carry on paying the mortgage etc.

    What she needs to know is if there is anyway that his name can be taken off the deeds or even a letter be done by a solicitor, stating that he has no claim on the house.

    Has anyone any advice on this please.

      She will have to get in touch with the mortgage lender they will have the info and costs etc and I doubt she will be able to do it at all without his consent.

        Thanks Di, its as I thought, and of course it has to be friggin Santander who are not known for there helpfulness.
        She's had an offer yesterday on her house, well below the asking price and of course, bless her she is looking at houses well out of her price range, because she's been told my the Estate Agent its a buyers market out there, so now she thinks she can get an equivalent house for sod all money.
        Ho hum, me thinks we should all move up north where the prices are cheaper lol.

          The mortgage lender will have the information and costs etc, and I doubt she will be able to do it at all without his consent.

              Sorry Sapph, Just spent 30 mins googling this and reading all sorts of scenarios where people wanted to do this. The only answers seem to be get his consent, or it's entirely up to the mortgage company.

                Might his name be removed if he were to die?
