  • New tenancy agreement-Confused!!

    Moved into property 3 years ago with 3 year tenancy agreement (oct 2007-oct 2010)

    Re-negotiated rent with landlord in June last year instead of leaving for a cheaper property

    Landlord wrote new agreement with new rent for 1 year (June 09-June 10) by crossing out the dates on the old agreement and amount of rent and changing them.

    Ok, yesterday I received a new tenancy through the post, here's the confusion:

    it says

    Tenancy start date 7th June

    Length 6 months

    and a note in it saying please can I sign and return

    Now the only thing that springs to mind is I KNOW my deposit was never put in a deposit scheme, it's nagging me that he is intending to end the tenancy soon and he realises this regarding the deposit and is now putting it into (or has since put it into a scheme)

    I can't think of any other reason for this new tenancy lasting 6 months and am expecting notice because of it :-(

    Why else would I get this new agreement that is backdated?

    I'm probably being simple (again) but wouldnt the new one be because the old one ran out 7th June 2010, so this new one covers June '10 onwards. 6 months is pretty standard and if he was planning on anything in Oct 2010 when your original 3 year tenancy ran out then he's kind of made it about the same by putting 6 months on from June so giving an extra couple months from the original ?

    If you are on good terms with the landlord you could always ask him why the new tenancy is only for 6 months when your original was for 3 years.

      Thanks Ame, it did cross my mind, but doesn't make sense because sending it me now means it ends in 2 months, and any tenancy after an agreement runs out runs on with 2 months notice having to be given, so seems kind of pointless, unless as I say theres another reason behind it!

      I think I'm confusing myself now! I think I've kind of convinced myself he's covering his back with the deposit scheme now and I will get notice in a couple of months. Honestly, I don't want to sign it if I stand to be in a worse situation than I am now

      I don't have any contact at all with my landlord, he's hardly ever in the country, and tbh that really suits me as I've lived here and totally felt like the house was our home, BUT i do know it suits him too as he has lots of properties.

        It is the norm to have 6 months contracts now so don't be afraid of that, is it an agent or do you pay the owner yourself?

          I pay the owner direct by bt every month, no agent involved.

          Had a look at the link you sent and I'm still of the same opinion, I automatically went onto a 'periodic tenancy' after my agreement ran out, so I'm sure now the only reason for sending me a new agreement that runs out in two months is because it clearly says on this new agreement 'deposit registered with ...' and he wants it all above board for when he gives me notice

          Previously it wasn't and should have been.. oh well at least I should be sure of getting my deposit back now :tinysmile_hmm_t2:

            landlord said when I finally managed to get hold of him it was a complete oversight and would sort out a new agreement asap :-)
