I bought my house from the Council, which resulted in my being reposessed after facing divorce and a being working mum with two children and horrendous childminding fees, I just couldnt manage. (inflation very high at the time)
Anyway, I was repossessed approx 1994 - I can remember only too well being marched out of my home with my two children in tow asking the bailiff who attended my home, if it would be ok for my furniture to remain there until I could sort something out. I was totally compliant and willingly handed him the keys.
He immediately changed the locks and pasted a poster on the front door, telling all and sundry of my eviction and the house repossessed etc. I was mortified.
I was given temporty accommodation (grotty b & b) and the whole situation took its toll on my health and I soon deteriorated so much it led to my losing my job and suffering a nervous breakdown.
Eventually I gradually picked myself up and began to rebuild my life and future with my children and rehoused in totally different area - no looking back.
However, some years later, when I had moved on (mentally) I wondered how much my house was sold for etc and decided to try and get some info (maybe I was owed money??)
The mortgage lenders, National & Provincial - ceased trading and had at some point been taken over by Abbey National (now Santander). So I wrote to their head office, giving full details info of property/mortgage a/c no etc (I had, still do - my mortgage details etc - so able to provide very specific information to help them trace info. Plus, I think they should have provided such info at the time, but neglected to., I was in no fit state to pursue at the time.
However, try as I did, after approx 2 years of corresponding (they were very slow and tried ignoring my letters) the final blow came, when I received letter from Abbey saying they were unable to help as records of such transactions (mortgage/ property sales etc) only held for 5 or 6 years, so they had no longer any way of getting any details/info for me in relation to this.
So my search for ended there!
Since that time, which was a few years ago now, I have got to thinking about this and thought - I bet if I were to apply for a mortgage or buy another council property, they would soon find that information and prevent me from proceeding further??? If what the Abbey National said is true, then anyone repossessed like myself, need only sit tight for 5 or 6 years and start again, with a fresh slate.
Does anybody know what the true Legal position is here and if at all possible, who might hold such information and how I might access that info at this now, very late stage???
