  • Issues with Help to Buy - Lenvi

    Hi there,

I would appreciate some help if someone can give it.

We are in the process of trying to remortage our Help to Buy property at the moment and are now at the mercy of Lenvi who are now in charge of administering Help to buy loans.
In order to remortage we essentially need permission from them in order to do so. We filled out all the relevant paperwork and were told it would take around 6-8 weeks, which was fine as we had around 11 weeks before our very expensive SVR kicked in on our mortgage.

Fast forward to last week and I realise they haven't contacted me to arrange for payment of the fee, upon calling them to find out if everything was moving along I am told that my case has not moved since I emailed the forms back to them. I immediately put in a complaint as I was told it was now going to be 6-8 weeks from now that this would get done, but they are now refusing to expedite this even though we are due to lose an unaffordable amount of money due to their incompetance.

Should I threaten them with small claims court? If I were to take this to small claims am I likely to get this money back?
If they do take 8 further weeks it's likely going to cost us around an additional £1000 in additional interest, that is not mention the hours and hours I have spent on the phone trying to get this resolved.

thanks very much for your time.

You could try going to the Financial Ombudsman service. I’m not sure if Lenvi direct you to this service but I can say the previous administrator did as you can find ombudsman decisions online
