    Hi my brother and I are selling our late mother's property. We have signed the sale contract but not signed the agreement on how to split the proceeds. The settlement papers are drawn up just need to get my brother to sign them.

    ​​​​​​My question is, once the conveyancer has the house proceeds in their bank can I draw on that money immediately or do I have to wait for the settlement to be signed?

    If you and your brother have not agreed the division of the money, then your solicitor would be wise to hold on to the money until you have both resolved that question and given clear agreed instructions.
