I'm new to the forum and I just wondered if I could ask for some advice here. A friend and myself own about two acres of land in a small village and we recently were informed that one of the large trees around the perimeter had fallen across two neighboring gardens. We will incur some expense in:-
a), removing the tree
b), making good the two neighbors fences, and
c), replacing some garden furniture, shrubs and a small apple tree.
I wonder if someone could advise us on what responsibility we have as owners of the land that the tree was growing.
There did not appear to be any excessive wind and while the tree appears to be healthy the collapse has indicated there may be some rot around the bottom. We have carried out a periodic visual inspection of the land, the last one being some six weeks ago and looking at the perimeter from the interior of our land, all trees looked to be in good condition. However, the neighbor tells us he had recently noticed that the tree had been leaning a little. Whether this was the case or not we are not certain but we were not informed and little or no effort seemed to have been made to establish our ownership in order to advise us. The first we knew about the incident was on 22 nd May 2024 and my co-owner and myself visited the site on the following day.
Currently we are arranging for the tree removal and would appreciate your advice on our liabilities'.
