  • Stamp duty 3% waiting for HMLR to take my name off last house

    I am waiting for HMLR to register a transfer of a property out of the joint names of my ex and me into her sole name. The application was sent to HMLR in August.

    I own no other property but will want to buy somewhere sometime soon.

    I can't get clarity on whether the house still being in my name on paper means I will be liable for the 3% surcharge on stamp duty that people have to pay when buying a house when they already have a residential property.

    Can you give me any advice, please?
