  • Right of way across recreational land

    We currently live in a house which backs onto playing fields approx 11 acres. We have a Gate that goes directly out onto the field. This gate has been in place for around 40 years along with most of the other houses. We have lived here for over 17 years.

    Once into the playing fields there are 3 entrances/exits. The main entrance has a car park.

    The playing fields are owned by the parish council. In their infinite wisdom they have decided to put gates into the car park (one pedestrian and one vehicle) and a fence. So they will effectively obstruct any access after they lock the gates.

    I don't know if they have plans to do anything with the other entrances.

    With it being owned by the parish council, does it count as public land? With it having paths across it for 40 years does that become a right of way? As we have used it as a through fare by foot for so long does it become Tight if way for us?
