    Hey, Thanks for having me here and helping

    So sadly i lost both my parent's a few months after each other, 3 Sibling inc myself was named executors

    Arrangements was made that i would be dealing with all the legal things relating to there death's and Sole probate was granted to myself. (other 2 sibling was power reserved which they agreed too and was given notice) To bring the house up to standards and sell the property and split it between my sibling and myself the benefactors. (as per the will wished)



    He as no agreements or tenancy and was bailed to the address over domestic violence abuse, He went to court and did he's punishment. Sadly he was still there when they died.
    a Section 8 and Section 21 don't seem to apply here cause he as no agreements or tenancy. At most maybe licensee and licensor?

    We told him to leave so the house could be worked on, (New wiring, Plastering, Carpets ect) He as declined to leave, When we go to the property to work, We have to wash up, Clean the house before we even start working and he as now been living there for over 8 months and now lets he adult son live there (Rent free)

    All utility Bills are in my name and he isn't on the electoral list.

    As i have Sole Probate and he is a non active executor, What can i do ? He as turned down 2 temporary places to live by the council, So he isn't being forced on the streets or homeless

    Advice please ? : )

    Who is "he"? Are you trying to tell us that one of your brothers is living in your late parents' house?

        Also in this time period he as registered a company/Brought a small pub with our address listed as being used without our consent (Most likely with the money he as been saving by not paying any rent at another house) and also Bailiffs are knocking the door for money collections because he is in debt.

              This is a complex situation and people will not reply if they do not have expertise. People can register a company at an address and there is little you can do about it (I have come across this as a landlord). There are ways to remove people legally but you have to get them right to avoid falling foul of the law. Perhaps a specialist eviction company? My other suggestion would be to post on Landlordzone which is a specialist site - use their search function and you may find info from others who have been in a similar situation. Good luck.
