  • Can a charge be put on this house?

    I posted on the care forum but I think it's the wrong place.
    I've owned a rental property with my mum for 16 years. She had a stroke 12 years ago and had to go into residential care. When her savings and the proceeds from the sale of the house she'd lived in ran out, the council took over and deferred payment, other than the full rent from the house which goes direct to them (I don't take my share). So a debt has built up

    Mum and I are joint tenants, so when she dies, her share of the rental property should revert to me. But the council rep muttered about putting a charge on it to meet some of the debt. Can they do that without my permission?

    I think that the Council will / possibly enforce that debt, you will I expect to receive a Court summons, just my thoughts, anybody can apply for a Charge on the property, but it would have to go to Court for a Judge to decide, then it rather depends on the amount of the debt, resulting in the Council would have to be paid, to clear their loss. That will lift the property charge.
