  • Land Registry Fraud Adverse Possession

    Hi there,

    hope you’re all well. I was wondering if someone can help with a huge issue I have with Land Registry.

    I had a strip of land against my neighbours fence which from 2007 to 2022, I did not know it didn’t belong to me but was still registered to the property developer who built my house 40+ years ago.

    In late 2021 my neighbour somehow realised this, moved the fence, gazumped the land and applied to LR claiming adverse possession. Oddly LR approved and gave him adverse possession without as much as consulting me. I only found out after I sold my house that this had happened. Throughout the period I was selling my house I was talking to local people and family to see if anyone can make my neighbour see sense and return the land.

    My neighbour lied to LR stating he has had the land since 2007, and according to the lawyer who dealt with the application this statement of truth was sufficient in terms of evidence.

    however I have over 20+ photos from aerial mapping and Google which prove he did not have the land as he claims. I also have a video too which shows my grand children playing on the land.

    I have submitted all this to LR, and despite this, they state that my neighbours statement of truth is sufficient and that Google, apple, getmapping, personal video are all wrong even though they are all dated.

    Also LR are saying that they don’t have a fraud dept either even though you can report an application as fraud. Basically it’s just for name sake.

    Can someone please offer some advice what I can do?

    Decide how much the land is worth, and keep things in proportion. HMLR faced a lot of claims and compenstion.
    What you describe sounds open and shut (but we haven't seen it), so stick with it. There are formal procedures they cannot escape,
