  • Land Registry Dispute - Neighbour won't let us claim back our land



    Hi everyone.

    We've just purchased our first property, and the back of our garden isn't fenced off to next door so we are trying to work out the boundaries. Our land registry clearly states that we own the back of next doors garden, so we are looking to get a fence put up to claim the land back as ours. The landlord next door however is saying he will need to get solicitors involved as it's been like that for many years (he first purchased the property in 2014). From what I'm reading he would need proof of this for ten years and for us not to object to claim the land as his, is this correct? Has anyone else had similar issues and can offer some advice? His registry also clearly states that part of the garden is not his.

    In next breath he's also now asking to buy the land off us so I'm not sure if he is just trying to scare us with solicitor talk as he clearly knows that the land belongs to us.

    The garden in question is at the bottom of the image. As you can see there is a little black line where the current fence it up, but it looks like our boundary goes into the back of their garden so we'd like to get this fenced off. We've also paid on the gov website to take a look at his land registry and it all matches up to ours.

    At what point can we just put a fence up and claim the land back?

          Given the match between LR title plans, you could just put up a fence, but if this gets difficult I think you may need to get solicitors and possibly a specialist boundaries surveyor involved. Do you have legal expenses insurance cover?

            UPDATE:

            The landlord next door bought the property in 2014, and from google street view I can see that in that time the part of garden in question was actually part of our garden as it states on registry. In 2015 it was fenced off by what I assume is next door. Is this proof enough to show that this has always belonged to us?

              I am not at all clear that you can derive those assertions from the plan shown.
