  • Rent to serviced accommodation contract issue

    Bit of a complicated situation so I will do my best to explain it as simply as I can.

    I have rented 2 apartments that are with a management company renting out as serviced accommodation. There was an issue with the window in one of them so contacted the landlord to see if anything could be done, thinking they might be under warranty as it's a relatively new development. The landlord said no they are not. Landlord is actually a mesne tenant, so rents from the main landlord/owner and rents to me and I list as serviced accommodation. I knew this going in and was assured it was all above board. After doing a bit of digging with management company I found that someone else doing the same thing as me in the building had same issue with window and that they had spoken to the main landlord/owner of building. So I got the number and have been informed that my landlord is in breach of contract as they did not know about subletting to me or the other person. I asked for a copy of the contract between main landlord and my landlord to confirm this and received in reply, send me your contract and then they would send theirs, which seemed weird so I left it there. I looked them up and the company has had numerous fines for health and safety related things and also dodgy building practices. Anyway, I kind of want out of the whole thing as they both seem like quite unsavoury characters. I didn't get that impression with my landlord initially but they were trying to sell me something at that point in time. I get the impression that the main landlord doesn't really care as they're getting paid so will probably be happy to let my landlord carry on subletting, maybe update the contract. Ideally I would want them to cancel the contract with my landlord for breach and then I could potentially go after my landlord for the sourcing fee + compensation. I don't think they will do this though as they would have to find a new tenant, which leads to my other option of having a contract drawn up with the main landlord. Correct me if I'm wrong, my understanding is that, as long as the contract between my landlord and the main landlord is still active then my contract with my landlord will be too. The main landlord would have to cancel the contract for breach for mine to become invalidated. So now the main landlord
    is aware of subletting, if they don't do anything about it, they are basically saying it is ok.

    It's a lot to digest I know. I would appreciate any advice or options I might have that I haven't considered or similar situations people have gone through and their actions and outcomes.
