  • Burial Sites in Garden !

    Our neighbour who used to live on our house and now lives next door (see my other post !!!!!!) has told us that she owns some ironwork in our garden and the koi carp in our pond.

    There is nothing in the deeds to say that she owns these items and she wishes to just pop in and take them. We wish to keep them !

    We have been trying to negotiate with her to reach a solution, ie she needs to buy them from us as we would wish to replace them but she is not agreeing to this. Following these discussions, she then told us that the ironwork were 'grave markers' and her late father and husband are buried underneath them. Again there is nothing in the deeds to advise that we have graves in our garden and what should happen to the grave markers. We have contacted the previous owners (there are 2) and neither had any idea about this either.

    We are obviously quite shocked about this (we have lived here for 2 years) and have done some research into the situation. She has threatened to tell the estate agents etc and any interested parties should we wish to sell in the future and she has said that it could devalue our property by up to 50% which it seems could well be the case.

    We asked her to contact the home office to find out how to disinter the graves and ensure that legal and proper paperwork is done so that we have no issues should we wish to sell in the future. She has refused to do this and is still wanting to just come and take the ironwork (but leaving the bones/ashes???) behind.

    We believe that she did not do the proper paperwork when she sold the house as she wanted to maximise her sale price (she is very money orientated) so could this be seen as fraud????

    Advise on what we do next would be much appreciated.

    Can you please clarify: is it the case that you are the 3rd owner of this property since this charming lady lived there? Can you give dates?

      That the deeds say nothing means nothing - they wouldn't.

      Do the ironworks suggest any memorial?

        Hi There. Yes we are the third owner since she lived her. She first sold in 2005 I believe and then it was sold again in 2017/18 and we bought it in 2020.

          No the ironworks do not suggest any type of memorial. I was under the impression that grave should be marked on the deeds in case they are dug up and ensuring that the police did not have to get involved??

            And she claims that these things have been her property since she first* sold the property 17 years ago?

            Have you considered politely declining her requests? Looking at your two threads, you have a neighbour whose behaviour is bordering on the controlling and coercive.

            On the subject matter of this thread, you should find out more about these alleged burial sites..

            * How many times has she sold the property?
