    Hello,

    We have bought a flat in November 2020 and after 10 months Clarion Housing Association have sent us an invoice in regards to some major works that had been carried out back in 2018.

    During the buying process the seller hasn't mentioned anything about these repairs or about any unpaid invoices. Clarion Housing Association hasn't brought this to our attention either (to any of the solicitors involved) and we were happy to sign the contracts without knowing about these unpaid invoices for the major works.

    Clarion discovered about this mistake after we've moved in, they've admitted in writting (email) that this was a mistake on their end - by not communicating this prior the exchange of contracts - but they're still asking us to pay the £12.000 for the works.

    These major works aren't showing up on any of our documents, there's no mention about any unpaid invoices or about anything that could suggest that we've missed these (costly) details.

    If we knew about these issues beforehand we've probably took a different decision in regards to this property, but unfortunately we're finding ourselves into this costly situation.

    Clarion insists that we have to pay the outstanding amount as we're now the legal owners of the property even though we were not aware of these before and even after moving in.

    We are in very difficult situation and the amount of stress that we're going through is unbearable, Clarion is pushing us to pay the £12.000 and threatens us in various ways.

    Based on the above details what options we have?

    Should we pay the £12.000 that we knew nothing about it?
    Should we go to Court to solve this issue with Clarion?
    Or... what can we do?

    Look to your lease. We cannot say without seeing it, but it is likely that you owe it. Do your neighbours have similar bills.

    Your solicitor should have picked up on this on the purchase. He (and you) need to check his file - he may have been misled also.

    There is a chance that you can recover it from the sellers - but you do not yet know.
