    Good evening,

    I would like to thank you in advance for any help you may give.

    My sister signed a 1 year tenancy on a HMO 1 bedroom in a shared house in Belfast (this house has 8 bedrooms and 4 bathrooms, communal kitchen and living room). At this point she has paid the deposit and 1 months rent in advance (totalling £495) just based on seeing the property, on the estate agents website.

    She picked up her keys yesterday and was advised that she would be in room number 8. So off she goes to the room to check it out and it is filthy and isn’t the same room that was advertised online. The conditions are horrendous, mould in the bathroom, body hair that has been shaved in the shower which hasn’t been cleaned, cigarettes and things remaining from the last tenant. She went straight back to the estate agent and asked if there was a way to get her deposit back and basically said no and that she needs to pay £350 to get out of the contract. They offered to get cleaners out the following day (this morning) and she has just went back at 7pm tonight after work and it’s still in the same conditions as yesterday.

    I spoke to housing advice online who said she can try to “unwind the contract” but I’m struggling with what legislation there is to help her write it.

    I would be very grateful for any guidance on this matter. As I feel they have misled her and pressured her into the contract at the time, as they said they would have passed it on if she didn’t pay the deposit and rent in advance that day.

        Do we have anyone with knowledge of landlord & tenant law in Northern Ireland?

          It is possible we do but they have not replied yet. It looks to me like the property just needs a good clean and this is the thing to insist upon. I would be back onto the agents. If it genuinely is a different room than the one advertised then it is probable that misleading selling laws come into it. The issue probably is, would the tenant stay in this room if it were clean. If the answer is yes, harass the agent until that happens. You could even say if it is not done by a certain date you will pay for it to be done and deduct from the next month's rent. May or may not be legal but the only thing which makes people take notice is the threat of losing money...

            another suggestion would be try the forum Landlordzone - for tenants and LLs (just google it) - you may get more specialist help there?
